Welcome to Sellinmalta ("Sellinmalta"). The Sellinmalta website is provided to you by Zedbros Communication SL ("Zedbros"), located at Ronda Alfons XII, 84 1-2, 08302 Matarò (Barcelona), VAT: ES-B67076190. By accessing Sellinmalta you agree to the Terms of Use described hereunder.
1. Scope of Agreement
The usage of Sellinmalta is bound by the Terms of Use set by Zedbros. Failure to comply with any of the stipulated terms in this agreement may result in the suspension or termination of your account, and in some instances legal actions if required.
2. Object of Agreement
2.1 The Sellinmalta website is an internet platform where users can publish and respond to classified ads. Users are solely held responsible for the content they submit on Sellinmalta, as well as any consequences that arise from doing so.
2.2 Zedbros is not involved in any transaction, contract and/or arrangement that might occur between and among users and third parties. The conclusion of such transactions, contracts and/or arrangements remain the business of the users and the third party.
3. Eligibility
The Sellinmalta Service is not targeted towards, nor intended for use by, anyone under the age of eighteen (18). If you are under the age of eighteen (18), you may use the Sellinmalta Service only under the supervision of a parent or legal guardian who agrees to be bound by these Terms and any applicable additional terms. You further represent and warrant that you: (a) have not previously been suspended or removed from using the Sellinmalta Service; (b) are legally permitted to, and do, live in Malta and (c) may enter into this agreement without violating any other agreement to which you are a party. If you are registering to use the Sellinmalta Service on behalf of a legal entity, you further represent and warrant that (i) such legal entity is duly organized and validly existing under the applicable laws of the jurisdiction of its organization, and (ii) you are duly authorized by such legal entity to act on its behalf.
4. User information and registration, purpose of Advertisement
4.1 The usage of Zedbros’s services is essentially available for everyone. A user registers on Sellinmalta by filling out the provided online registration form, and by doing so swears that the information provided is accurate and true. The registration progress is complete when the account becomes active. The user is obligated to promptly inform Zedbros of any changes to their account information.
4.2 The user may resign from this agreement at any time. Sending an email through the contact form . Zedbros reserves the right to a grace period of 14 days before terminating the agreement. Blocking an account remains the right of Zedbros, as stated in clause 5.3.
4.3 An entry on Sellinmalta, referring to a classified ad, can only be published online via the following method: Zedbros confirms the entry through an email and publishes it online.
4.4 Zedbros reserves the right to refuse a user’s classified ad entry under certain circumstances. This applies when the content of a classified ad goes against this agreement, violates laws and local authority regulations, contravenes good intentions, morals and customs or when Zedbros is used for unsuitable purposes.
4.5 Zedbros reserves the right to delete the accounts of registered users whose account(s) has/have been inactive for the past 6 months.
5. Accountability for Advertising content
5.1 The user is legally and solely responsible for the content of the advertisement(s) placed on the Sellinmalta website. The user is obliged to provide complete, true and certified correct information about their person, contact details, business details (if applicable) and must provide sufficient descriptions in regard to the advertisement being placed. The user agrees to place their advertisement under the correct category within the website. The user is obliged to comply with the Sellinmalta Terms of Use and is expected to adhere to these terms when interacting with other Sellinmalta users. The placement of duplicate/similar ads on the website is prohibited. Business owners offering items and services are obliged to inform consumers about consumer rights and the rights of withdrawal/cancellation, should this apply.
5.2 The user is not allowed to post content on the Sellinmalta website that breaches this agreement, applicable rights and/or third party rights. Prohibitions for the Sellinmalta user include:
- Violating the law
- Going against the Prohibited Policy
- Conducting business in a dishonest and/or deceptive manner
- Violating the rights of the third party
- posting any threatening, abusive, defamatory, obscene or indecent material
- Spamming, posting chain letters, and placing ads for multi-level marketing ("MLM") and pyramid schemes
- Using virus(es) and other technical items that may cause damage to Sellinmalta or the interest of the users of Sellinmalta
- Causing excessive burden on the Sellinmalta infrastructure and the smooth running operations of the Sellinmalta website
- Copying, duplicating, modifying or distributing the content of other advertisements
- Collecting information from other users such as email addresses from the site itself, or from other users without the approval of the user
- Bypassing measures that serve to limit and/or prevent access to Sellinmalta
5.3 Zedbros has the right to block, delete or freeze advertisements, accounts or memberships that are deemed to contain prohibited content (refer to 5.2). Zedbros also has the right to warn the user and freeze their account for a certain period of time or permanently and to resign from the agreement/contract. In this process Zedbros gives due respect to the legitimate interest of the user. Users’ claims, e.g. for reimbursement for already paid items/services will not be honored when the Prohibited Content Policy is breached. Zedbros may monitor your data held on our systems in relation to the use of Sellinmalta, including your listings and any messages sent or received from other users to ensure our terms and conditions are satisfied.
5.4 Zedbros will not share your data held on our systems with any third party, unless required by law.
6. Indemnification/Exemptions
6.1 Sellinmalta users are obliged to release Zedbros from any claims or lawsuits brought forward by other Sellinmalta users or third parties who have been in any way affected by an advertisement’s content. Sellinmalta users must shoulder any costs/claims arising from lawsuits directed at Zedbros, including all legal and juridical costs.
7. Fee and Payment
7.1 The usage of the Sellinmalta website is essentially free of charge. However, Zedbros reserves the right to charge fees for special services and site features as well as the publication of online advertisements under specific/certain categories on the site. Zedbros will make clear when a user applies one of these features that a fee payment is required and Zedbros will give the option to accept or decline the feature.
7.2 Each and every fee shall be due for immediate payment and shall be paid for/settled using the different methods of payment offered on the website. Costs that may arise from aborting the payment collection shall be shouldered by the user and not Zedbros.
7.3 Our fees are non-refundable, and you are responsible for paying them when they're due. In the event of delayed payments for these services, Zedbros reserves the right to suspend the execution of the said service(s) and restrict the access of the user until the amount due has been paid.
7.4 Zedbros reserves the right to change/modify the fees for services associated with premium features on the website without prior notice.
7.5 All Fees are denominated in euro.
7.6 You may only pay Fees using valid payment methods acceptable to us, as specified via the Sellinmalta Service. You represent and warrant that you are authorized to use the payment method you designate. You authorize us to charge your designated payment method for the total amount of your purchase, including any applicable taxes and other charges. If the payment method cannot be verified, is invalid or is otherwise not acceptable to us, your order may be suspended or cancelled.
8. Modification of Advertisement Content
8.1 The Sellinmalta user may at any time modify or delete their advertisement.
8.2 The Sellinmalta user has the right to demand the removal or deletion of the user’s own ads from the website. Zedbros shall be ready to comply with this request immediately. However due to technical reasons, this usually takes a period of up to 24 hours.
9. Infringement
9.1 Do not post content that infringes the rights of third parties. This includes, but is not limited to, content that infringes on intellectual property rights such as copyright and trademark (e.g. offering counterfeit items for sale).
9.2 In order to report an infringement, you will need to file a report using the "Report Abuse" feature provided with every listing or in the "Help" section. The information provided must be sufficient for us to ensure that you are either the entitled party or their officially authorized representative. This information must also enable Zedbros to identify the advertisement to be removed. Once we have received your report, it will be reviewed and action will be taken within reasonable time.
10. Liability Limitations
10.1 The user agrees not to hold Zedbros responsible for things other users post or do. As most of the content on Sellinmalta comes from other users, Zedbros does not guarantee the accuracy of postings, user communications or the quality, safety, or legality of what’s offered. Continuous or secure access to Zedbros’s services cannot be guaranteed. To the extent legally permitted Zedbros expressly disclaims all warranties, representations and conditions, express or implied, including those of quality, merchantability, merchantable quality, durability, fitness for a particular purpose and those arising by statute.
10.2 Zedbros is not liable for any loss, whether of money (including profit), goodwill, or reputation, or any special, indirect, or consequential damages arising from the usage of the Sellinmalta website, even if Zedbros has been advised or could have reasonably for seen the possibility of any such damage occurring. Some jurisdictions do not allow the disclaimer of warranties or exclusion of damages, so such disclaimers and exclusions may not apply to the user.
10.3 Despite the previous paragraph, if Zedbros is found to be liable, the liability to the user or any third party (whether in contract, tort, negligence, strict liability in tort, by statute or otherwise) is limited to the greater of (a) the total fees the user paid to Zedbros in the 12 months prior to the action giving rise to liability, or (b) 100 Euros.
11. Miscellaneous
11.1 These terms and the other policies posted on Sellinmalta constitute the entire agreement between Zedbros and the users, superseding any prior agreements.
11.2 This Agreement shall be governed and construed in all respects by the laws of Malta. You agree that any claim or dispute you may have against Zedbros must be resolved by the courts of Malta. The legal relationship between Zedbros and the Sellinmalta user is subject to the exclusive jurisdiction of the Maltese Courts.
